• Technical details such as IP address, browser details, device details, OTP verification logs, login timestamps, and activity logs.

1. Acceptance of Terms

By accessing the website, registering, logging in, uploading documents, submitting an application, or using any service, you agree to these Terms and Conditions. If you do not agree, you should not use the platform.

2. About BEMENOS SMART LOANS

BEMENOS SMART LOANS helps users submit home loan application details, upload documents, track application status, receive missing document requests, and coordinate with banks, NBFCs, housing finance companies, authorised DSAs/connectors, legal reviewers, technical reviewers, and service providers.

3. We Are Not a Lender

BEMENOS SMART LOANS is not a bank, NBFC, housing finance company, lender, credit bureau, or loan sanctioning authority. We do not provide loans directly, sanction loans, reject loans, disburse funds, collect EMIs, or guarantee loan approval. Final approval, rejection, sanction amount, interest rate, tenure, processing fee, legal clearance, technical clearance, and disbursement are solely at the discretion of the respective lender.

4. User Eligibility

You must be legally competent to enter into a contract under applicable law and must provide true, accurate, complete, and updated information. You are responsible for ensuring that all details and documents submitted by you are genuine, readable, legally valid, and lawfully obtained.

5. Account and OTP Login

You may access the platform through mobile number and OTP verification. You are responsible for maintaining control over your mobile number, device, email address, and account access. Any activity performed through your verified login may be treated as authorised by you.

6. Application Submission

The platform may allow you to save drafts, edit details, upload or re-upload documents, and submit your application. Once submitted, the application may be reviewed by the platform admin or authorised representatives. If information is incomplete or incorrect, the application may be reassigned back to you for correction.

7. Documents and Verification

You agree to upload only genuine, valid, and lawfully obtained documents. Uploaded documents may be reviewed manually or through automated/AI-assisted tools for completeness, readability, and basic consistency checks. These checks do not guarantee legal validity, loan eligibility, credit approval, property approval, or sanction by any lender.

8. Legal and Technical Validation

Where enabled, your application may be referred for legal validation, property document review, technical review, valuation support, or other checks. Such validation may be performed by third-party professionals, bank-appointed agencies, or service partners. Any result from such review is advisory or lender-specific and does not guarantee final loan approval.

9. No Guarantee of Loan Approval

Submission of an application through BEMENOS SMART LOANS does not guarantee loan approval, faster approval, lower interest rate, waiver of charges, legal clearance, technical clearance, or disbursement. Lenders may reject or hold applications based on their internal policies, credit checks, eligibility rules, property checks, legal checks, documentation gaps, regulatory requirements, or any other reason.

10. Fees and Payments

The platform may charge service fees, consultation fees, documentation support fees, convenience fees, or other charges where clearly shown before payment. Any platform service fee is for facilitation, documentation, technology, consultation, or coordination support only. It is not a bank loan processing fee unless specifically stated by the relevant lender.

11. Refunds

Unless otherwise stated at the time of payment, fees paid for completed consultation, documentation, application preparation, or facilitation services may be non-refundable. Rejection of a loan application by a lender does not automatically entitle the user to a refund.

12. User Responsibilities

• You must not submit false, forged, edited, misleading, or unauthorised documents.
• You must not misrepresent income, employment, property ownership, liabilities, identity, or loan purpose.
• You must not upload documents belonging to another person without valid authority.
• You must not attempt to bypass security, misuse OTP, access another user’s account, or disrupt the platform.
• You must not use the platform for unlawful, fraudulent, abusive, or unauthorised purposes.

13. Communication Consent

By using the platform, you consent to receive service-related communications through SMS, phone calls, WhatsApp, email, portal notifications, or other channels for OTP verification, application updates, missing document requests, status changes, payment updates, support, and loan facilitation purposes.

14. Third-Party Services

The platform may integrate with third-party services such as SMS/OTP providers, email providers, payment gateways, hosting providers, analytics tools, document processing tools, banks, NBFCs, financial institutions, legal reviewers, technical reviewers, and service partners. We are not responsible for third-party downtime, lender decisions, rejection reasons, charges, processing timelines, or policies.

15. Limitation of Liability

To the maximum extent permitted by law, BEMENOS AI TECHNOLOGIES LLP and BEMENOS SMART LOANS shall not be liable for indirect, incidental, consequential, special, punitive, or business losses arising from use of the platform, lender rejection, delay in processing, incorrect user information, third-party actions, document issues, credit decisions, legal defects, valuation issues, or service interruptions.

16. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Subject to applicable law, courts and competent forums in Hyderabad, Telangana shall have jurisdiction over disputes arising from or relating to use of this platform.
